This position is an Attorney III in the Enforcement Department. The Enforcement Department is one of seven departments in the Legal Services Division of the HHS Office of Chief Counsel. The Enforcement Department provides legal support related to HHS sanctions against facilities, programs, and services, including reviewing and drafting notices, correspondence, and guidance documents; interpreting state and federal laws, regulations, and rules; rendering legal advice and counsel to HHS agency personnel; providing legal representation in contested case proceedings, and overseeing enforcement litigation in district courts.
This Enforcement Department attorney represents HHSC before the State Office of Administrative Hearings (SOAH) in matters related to the regulation of childcare licensing (CCL). The subjects of the hearings include adverse actions against childcare permits and childcare administrator's licenses, as well as findings of child abuse or neglect made by DFPS that are relevant to HHSC's regulation of childcare.
The attorneys also provide a high volume of consultations for both the Centralized Background Check Unit (CBCU) and CCL.
Essential Job Functions:
Attends work on a regular schedule in accordance with Agency leave policies and performs other duties as assigned.
Reviews assigned cases to assess evidence, strengths and weaknesses of case, and to formulate a strategy for the case. Prepares cases for an administrative hearing, including identification and preparation of witnesses. Researches law, drafts pleadings, conducts and responds to discovery to develop effective legal strategies and to prepare for administrative hearings. (30%)
Represents agency in contested cases before SOAH. (30%)
Other duties as assigned and required to maintain unit operations, including liaison with Attorney General’s Office on Licensing enforcement cases, acting in a legal advisory capacity for licensing staff, and providing legal training to agency staff. (10%)
Completes timely and thorough consultations with clients on matters such as adverse actions and background check matches. (30%)

Knowledge Skills Abilities:
Knowledge and experience of Chapters 42 & 43 of the Human Resources Code, Chapter 261 of the Texas Family Code, and related rules and policy.
Knowledge and experience of administrative law.
Skilled in legal research, writing and analysis.
Skilled in handling multiple projects and meeting tight deadlines.
Skilled in demonstrating sound judgment.
Ability to independently handle a high volume caseload.
Ability to synthesize law, administrative rules, and agency policies and goals, in formulation of legal arguments and contested case trial strategies to effectively present the HHSC’s position before the State Office of Administrative Hearings.
Ability to communicate orally and in writing, including the ability to convey complex ideas and instructions clearly to staff.
The ability to work closely and productively with regional, state office, and executive staff.
Ability to analyze complex factual and legal issues related to a wide variety of federal and state laws.
Ability to use computer applications and databases related to essential functions of the job, including computer-assisted legal research, word processing software, and the Internet.
Registration or Licensure Requirements:
Graduation from an accredited law school with an LLB or JD degree.
Member in good standing with the State Bar of Texas.
Initial Selection Criteria:
At least two years of experience in the practice of law. Experience in Administrative Law preferred.
