This Assistant Attorney General (AAG) position is in the Financial Litigation and Charitable Trusts Division’s Financial Litigation group, which handles the State’s breach of contract
actions and related matters. We seek smart, creative, and ambitious lawyers who can analyze interesting questions of law and manage cases from start to finish. This includes prelitigation advice and investigation, hearings, discovery, negotiations, trials, and appeals, as well as drafting and reviewing potential legislation. Our attorneys have their own docket of
cases and most of them work collaboratively in teams on larger projects. This position will handle construction cases; software development, technology, and licensing disputes;
health care contracting matters; and more.
ESSENTIAL JOB FUNCTIONS
Prepares legal opinions, briefs, pleadings, motions, petitions, and other legal documents
Analyzes factual and legal issues; and develops evidence through witness interviews, depositions, and other discovery
Prepares cases for trial and tries cases before state and/or federal court
Represents the State’s interest in various civil matters relating to financial litigation, such as securities, insurance, banking, accountancy, contracts, construction, open records,
garnishment, unclaimed property, benefits, and various administrative law matters
Provides legal advice to client state agencies, board, and officials
Represents the Office of the Attorney General before state or federal district and appellate courts
Performs legal research and reports findings and conclusions
Assists in drafting bills and amendments for legislative consideration
Maintains effective working relationships with co-workers, attorneys, client agencies, and opposing counsel
Performs related work as assigned
Maintains relevant knowledge necessary to perform essential job functions
Attends work regularly in compliance with agreed-upon work schedule
Ensures security and confidentiality of sensitive and/or protected information
Complies with all agency policies and procedures, including those pertaining to ethics and integrity
MINIMUM QUALIFICATIONS
Graduation from an accredited law school with a Juris Doctor degree (J.D.)
Licensed as an attorney by the State of Texas
Member in good standing with the State Bar of Texas
Experience: Two years full-time civil litigation/civil trial experience as a licensed attorney
Knowledge of financial and securities law
Skill in conducting effective research
Skill in handling multiple tasks, prioritizing, and meeting deadlines
Skill in effective oral and written communication [Writing sample required at time of interview, if selected]
Skill in exercising sound judgment and effective decision making
Ability to receive and respond positively to constructive feedback
Ability to work cooperatively with others in a professional office environment
Ability to provide excellent customer service
Ability to work in person at assigned OAG work location, perform all assigned tasks at designated OAG work space within OAG work location, and perform in-person work with
coworkers (e.g., collaborating, training, mentoring) for the entirety of every work week (unless on approved leave)
Ability to arrange for personal transportation for business-related travel
Ability to work more than 40 hours as needed and in compliance with the FLSA
Ability to lift and relocate 30 lbs.
Ability to travel (including overnight travel) up to 5%
PREFERRED QUALIFICATIONS
Post-graduate degree in business and finance
One-year judicial clerkship in either federal or state court
Three years litigation experience in financial or complex litigation, including direct experience with discovery, motion practice, trial experience, and appellate litigation
Strong legal writing skills
