JOB SUMMARY:
TFC builds, maintains, and manages over 28 million square feet of state-owned and leased facilities that house over 62,000 state employees in over 100 state agencies; procures and manages leased facilities to meet state agencies’ needs throughout the State of Texas, managing over 800 active leases for 37 state agencies; and manages the disposition of state and federal surplus property.
TFC is looking for a Staff Attorney to perform advanced (journey-level) work with a collaborative team of legal professionals in the General Counsel Division. Work involves a variety of responsibilities including, preparing, and reviewing legal documents, interpreting laws and regulations, and rendering legal advice and counsel.
ESSENTIAL FUNCTIONS:
- Performs highly responsible professional legal and administrative duties.
- Advises staff on legal matters and on the interpretation and application of state and federal statutes, administrative rules, and agency internal policies and procedures.
- Researches and analyzes applicable statutes, case law, opinions, rules, and regulations.
- Responds to Public Information Act requests, including drafting ruling requests to the Attorney General’s Office.
- Manages property damage claims submitted to the agency. Refers claims to the Attorney General’s Office, when necessary, and liaises with the assigned Assistant Attorney General until the case is resolved.
- Drafts and reviews legal documents, including contracts, leases, memoranda, administrative rules, policies, and procedures.
- Reviews legislative bills to evaluate impact on TFC operations and draft amendments, if requested. Assists in implementation of new or revised legislation after the legislative session.
- May assist contract specialists with the preparation and coordination of legal contracts and amendments.
- May prepare and review transaction documents related to the State’s purchase, sale, or lease of real property.
- Performs related work as assigned.
Required Qualifications (Minimum Qualifications)
- Knowledge of state and federal laws and administrative rules and regulations affecting the agency.
- Skill in legal research, writing and analysis.
- Skill in effective oral and written communication [writing sample required at time of application].
- Ability to work effectively and cooperatively with a variety of individuals and groups.
- Experience and proficiency in the use of standard computer applications, including Microsoft Office products.
- Maintains relevant knowledge necessary to perform essential job functions.
- Attends work regularly in compliance with agreed-upon work schedule.
- Complies with all agency policies and procedures, including those pertaining to ethics and integrity.
Education and Experience:
- Graduation from an accredited four-year college or university.
- Graduation from an accredited law school with a Juris Doctor degree.
- Member in good standing with the State Bar of Texas.
- Five years of extensive and progressively responsible legal and administrative experience.
KNOWLEDGE, SKILLS & ABILITIES:
- Knowledge of legal principles, practices, and proceedings; of state and federal laws, regulations, and rules; and of agency administrative rules and regulations.
- Skill in legal research, writing and analysis.
- Ability to conduct research, summarize findings, interpret, and apply laws, and use legal reference materials.
- Ability to communicate effectively, both orally and in writing.
- Knowledge of the Texas Public Information Act and Texas Open Meetings Act.
- Knowledge of commercial real estate transactions.
- Ability to maintain security and confidentiality of sensitive and/or protected information.
- Ability to develop and manage multiple tasks and schedule work to maintain regular progress on assignments.
- Skill in exercising sound judgment and effective decision making.
- Ability to receive and respond positively to constructive feedback.
- Ability to work cooperatively with others in a professional office environment.
- Ability to communicate effectively, both orally and in writing.
PHYSICAL REQUIREMENTS AND/OR WORKING CONDITIONS:
This classification functions in a standard office environment. There are no unusual dangers involved, but the position will have exposure to dust, environmental allergens, pathogens, and other microorganisms consistent with business activities and human contact. The position holder must be able to work effectively with people under varying conditions, must be able to work extended periods at a computer, and must be able to work longer than eight hours in a work-day as necessary. Physical requirements also include the ability to move items up to 30 lbs. and perform tasks requiring fine motor skills and coordination.
