JOB SUMMARY:

Performs advanced (senior-level) contract administration work for the Facilities Design and Construction (FDC) portfolio of construction contracts. Works under limited supervision, with considerable latitude for the use of initiative and independent judgment. Performs department wide contract administrative program administration and is responsible for the creation and maintenance of standard operating procedures to ensure consistency across the various contract management teams of the division. Program supports the FDC construction portfolio of large capital, deferred maintenance, and minor construction for the State of Texas. This role will serve as the subject matter expert within the FDC division for contracting and will be the designated liaison to the divisions responsible for contract actions.

ESSENTIAL FUNCTIONS:

  • Oversees, prepares, or coordinates project initiation in close coordination with the Project Manager to prepare the scope of work, specifications, and conditions for new contracts; coordinates with the Legal and Procurement divisions to prepare sample contracts; coordinates negotiation strategies; and manages the FDC workflows to award new contracts.
  • Oversees the operations and activities of monitoring contract performance, including developing and tracking key metrics department wide.
  • Provides the program management to ensure contractor billing is correct and ensure eligibility determinations for compliance with contract terms and agency policies.
  • Oversees and coordinates the processing of contract documents to ensure that the project team understands the requirements and limitations of the project scope and required documentation.
  • Develops short- and long-term strategies and goals for the administration of assigned contracts.
  • Investigates and resolves discrepancies, complaints, and disputes by negotiating settlement agreements or by canceling or terminating contracts.
  • Initiates and oversees process improvement and policy evolution to ensure a productive and compliant contracting environment for the growing construction project portfolio of the agency.
  • Serves as the principal contract liaison between department leadership, internal and external project teams, and other agency divisions, e.g. Legal and Procurement Services.
  • Provides portfolio contract management strategies to ensure consistency across diverse projects for contract budget, negotiations, risk management and overall contract monitoring at the departmental level.
  • Ability to exercise sound judgment in making critical decisions, to analyze complex information and develop plans, to interpret complex data, to effectively demonstrate negotiation and facilitation skills, to communicate effectively, and to supervise the work of others.
  • Plans, develops, and conducts presentations, and other special projects as assigned.

REQUIRED QUALIFICATIONS (MINIMUM QUALIFICATIONS)

  • Graduation from a four-year degree in business, construction administration, architecture, engineering, or a related field with a focus on contracts.
  • (Four) 4 years of experience in public construction contract administration or related field including contract initiation, management, evaluation, and monitoring.
  • Must be eligible to obtain the CTCM & CTCD certifications within 6 months of hire.
  • Education and experience may be substituted for one another on a year-for-year
  • Ability to maintain the security or integrity of the infrastructure of the State of Texas.

PREFERRED:

  • CTCM, CTCD, State Employment Experience within contract administration or related field including contract initiation, management, evaluation, and monitoring, four (4) or more years of contract administration work.

KNOWLEDGE, SKILLS & ABILITIES:

  • Texas Government Code Chapters 2151, 2152, 2161, 2165, 2166, and 2167, and applicable sections of the Texas Administrative Code (TAC 2261 and 2269) governing state procurement and contracting.
  • State of Texas contracting and procurement policies, practices, and procedures.
    Contract law, risk assessment, negotiation strategies, and performance-based contracting.
  • Budget management, cost analysis, and invoice processing related to complex, high-dollar contracts.
    HUB “Good Faith Effort” requirements, reporting processes, and participation goals.
  • Texas Public Information Act (Chapter 552) as it applies to procurement and contracting documents.
  • Principles of project management, performance measurement, and strategic planning.
  • Best practices in contract monitoring, audit preparation, and records management.
  • State funding processes and fiscal accountability standards.
  • Developing, drafting, and managing complex contracts, amendments, and interagency agreements.
  • Leading, mentoring, and supervising professional staff engaged in procurement and contract management.
  • Negotiating contract terms and resolving performance disputes.
  • Interpreting and applying complex laws, rules, and policies to ensure compliance and mitigate risk.
  • Using CAPPS Financial, SharePoint, DocuSign, Adobe Pro, Microsoft Office Suite (Excel, Word, PowerPoint), and contract management systems.
  • Conducting research, analyzing data, and preparing clear, concise reports for executive management and oversight entities.
  • Managing multiple projects and priorities while meeting deadlines under pressure.
  • Communicating effectively with executives, legal counsel, contractors, and oversight bodies in writing and verbally.
  • Exercise sound judgment, critical thinking, and initiative in decision-making.
  • Plan, organize, and evaluate contract administration activities to achieve agency objectives.
  • Build and maintain effective working relationships across divisions, with contractors, and with state partners.
  • Analyze and interpret financial data, performance metrics, and legal documents.
  • Present complex technical or policy information clearly to diverse audiences, including the Commission and legislative staff.
  • Promote accountability, transparency, and continuous improvement in contract administration processes.

PHYSICAL REQUIREMENTS AND/OR WORKING CONDITIONS:

This classification functions in a standard office environment.  There are no unusual dangers involved, but the position will have exposure to dust, environmental allergens, pathogens, and other microorganisms consistent with business activities and human contact.  The position holder must be able to work effectively with people under varying conditions, must be able to work extended periods at a computer, and must be able to work longer than eight hours in a work-day as necessary. Physical requirements also include the ability to move items up to 30 lbs. and perform tasks requiring fine motor skills and coordination.

 Work Schedule:

Positions are 40 hours per week and are scheduled Monday – Friday; Hours will be adjusted depending upon need of the department.
